Information of interest to prospective purchasers of a home in the Villages of Long Point Bay, Port Rowan, ON.

October 26, 2023 - Please note: The By-laws Committee is currently working on more revisions to By-laws & Policies to comply with the new Ontario Not-for-Profit Corporations Act. As the "ONCA" rules are now in effect, if there is a conflict between the VLPBRA By-laws and the ONCA rules, the ONCA rules take precedence.
2. IF SELLING OR LEASING YOUR HOME:
PLEASE BE REMINDED OF THE BYLAWS and PROTECTIVE RESTRICTIONS COVERING TRANSFERRING TITLE OR LEASING:
When transferring title of a property in The Villages of Long Point Bay, per Bylaw 16.1, the member is responsible for:
a) acquainting the transferee with the Bylaws and Policies of the Association;
b) ensuring that the transferee receives the membership form for the Association; and
c) ensuring at such time that all outstanding payments owing to the Association are paid in full.
Similarly, when leasing a home in VLPB, per Bylaw 16.2, the homeowner(s) is responsible for acquainting the Tenant* with the Bylaws and Policies of the Association. Before leasing the home the homeowner must obtain a Tenant Agreement from the Association. This agreement must be signed by the tenant and homeowner and returned unaltered to the Association. The homeowner, on leasing the home, loses the right to use the facilities of the Association.
* Definition of Tenant in the VLPB Bylaws:
"Tenant(s)" means any tenant(s) of a Homeowner. The tenant will reside in the home as his/her primary or main residence. A primary or main residence is the dwelling where the tenant usually resides or lives. A tenant(s) can only have one primary residence at any given time."
Note: Short-term rentals (such as Air BnB rentals) are therefore, by definition, not allowed in the VLPB.
In the Protective Restrictions, which are registered on title for all properties in The Villages of Long Point Bay, the following paragraphs are also relevant:
4 - USE OF BUILDING
The building shall be used and occupied for no other purpose than as a private residence and is to be occupied by not more than two persons. (Exceptions can be made by the Board on compassionate grounds.)
15 - TENANTS
If the Purchaser should lease or part with possession of the Building other than through a sale or transfer of title to the lot, the Purchaser shall only lease the Building in conformity with the adult-only lifestyle residential community and will require the tenant or occupant to execute and deliver the form of lease (if any) that has been approved by the Residents' Association.
And, one other reminder regarding non-members of the Association:
11 - USE OF FACILITIES
All guests must be accompanied by a member when using any of the Association facilities.
If selling your house, please cooperate with the Board by providing the VLPBRA office with information regarding any property sale. This allows for the collection of monthly dues. Please send an email to the office advising of the sale of your property, with the date of closing and names of the purchasers. Please note that all VLPBRA keys and fobs should be returned to the office and not passed on to the new buyer.
